Welcome to HighPeak. By visiting our website and/or purchasing something from us, you agree to the following Terms of Service (“Terms”). These Terms apply to all users of the site, including without limitation browsers, vendors, customers, and contributors of content.

Please read carefully. If you do not agree to these Terms, you may not access the website or use our services.

1. Online Store Terms

By agreeing to these Terms, you confirm you are at least the age of majority in your jurisdiction, or that you are the age of majority and you have given consent for your dependents to use this site.
You may not use our products for illegal or unauthorized purposes or violate any laws in your jurisdiction.
Any violation of these Terms may result in termination of services.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time.
Content (excluding payment details) may be transferred unencrypted across networks. Payment information is always encrypted.
You agree not to reproduce, copy, sell, or exploit any portion of the Service without our written permission.

3. Accuracy of Information

Information on our site may not always be accurate, complete, or current. We reserve the right to update or change content at any time. Your reliance on such information is at your own risk.

4. Modifications to Service and Prices

Product prices and availability may change without notice.
We may discontinue products or services at any time without liability.

5. Products & Services

Some products are available exclusively online. Quantities may be limited.
Colors and images are displayed as accurately as possible, but we cannot guarantee every screen shows them identically.
We reserve the right to limit sales, restrict orders, or discontinue products at our discretion.
We do not warrant that any product will meet your personal expectations.

6. Billing & Account Information

We reserve the right to refuse or cancel orders at our discretion, including suspected reseller orders.
Customers must provide accurate and complete billing and shipping information.
If an order is delivered to the provided address but not received by you due to incorrect details, we are not liable for refund or replacement.
It is the customer’s responsibility to ensure address accuracy. However, we will work with you to give a better solution.

7. Shipping & Delivery

  • Customers are responsible for any applicable customs duties, taxes, or import fees if applicable.
  • We are not liable for delays caused by courier services, customs, weather, or other events beyond our control.
  • Risk of loss passes to you once an order is marked “delivered” by the carrier.

8. Returns & Refunds – HighPeak Refunds+™

All returns and refunds are handled under our HighPeak Refunds+™ Policy, which provides customers with flexible and personalized solutions.

  • Standard Returns: 30 days after delivery. Items may be lightly used but not damaged or excessively worn.
  • Free U.S. Returns: For most items.
  • High-Value / Oversized Items: Returns may incur a restocking fee (refundable as HighPeak credit).
  • Exceptions: Perishables, personal care items, custom made items, bulky items, hazardous goods, digital products, clearance/final sale items, and gift cards cannot be returned.

9. Optional Tools

We may provide access to third-party tools, which are offered “as is” and without warranties. Use of these tools is at your own risk.

10. Third-Party Links

We are not responsible for third-party content, products, or services linked from our site. Customers should review third-party terms before engaging.

11. User Comments, Feedback & Submissions

By submitting content (ideas, feedback, etc.), you grant us the right to use it without restriction.
You agree not to post unlawful, defamatory, obscene, or harmful material.

12. Personal Information

Your submission of personal data is governed by our Privacy Policy

13. Errors & Omissions

We reserve the right to correct errors in pricing, product details, promotions, or shipping info at any time without notice.

14. Prohibited Uses

You may not use the site:

  • For unlawful purposes or to solicit unlawful acts.
  • To violate intellectual property rights.
  • To harass, abuse, discriminate, or defame.
  • To submit false information or upload malware.
  • To spam, scrape, or interfere with site security.

15. Disclaimer of Warranties; Limitation of Liability

We do not guarantee uninterrupted or error-free service.
Products and services are provided “as is” without warranties of any kind, except as expressly stated.
We are not liable for damages arising from your use of our services or products, except where prohibited by law.

16. Indemnification

You agree to indemnify and hold HighPeak, its affiliates, employees, and partners harmless from any claims arising from your breach of these Terms or violation of laws/third-party rights.

17. Severability

If any provision is found unenforceable, the remainder of the Terms will remain valid.

18. Termination

You may terminate these Terms by ceasing use of our site. We may terminate your account if you violate these Terms.

19. Entire Agreement

These Terms, together with our policies, represent the entire agreement between you and HighPeak.

20. Governing Law

These Terms shall be governed by and construed under the laws of the United States.

21. Disputes & Chargebacks

At HighPeak, we are committed to resolving every issue quickly and fairly. If you experience any problem with your order, you must contact us first at support@highpeakco.com so we may review and resolve the matter in good faith. We will always provide a reasonable resolution — including refund, replacement, or return options where applicable.

We strongly encourage customers to contact us before initiating a chargeback so that concerns can be addressed promptly and directly.

If a chargeback is filed after goods have been shipped or delivered, or if payment is reversed after fulfillment for any reason, the customer remains responsible for:

• The full transaction amount
• Any payment processor fees incurred by HighPeak as a result of the chargeback

If an unpaid balance remains unresolved after reasonable attempts to contact the customer and provide an opportunity to settle the matter directly, HighPeak may, as a last resort, refer the account to a licensed third-party collections agency.

Prior to escalation, HighPeak will make reasonable efforts to provide notice and an opportunity to resolve the balance. If the customer fails to respond or remit payment, referral to collections may result in additional administrative, compliance, and recovery costs to HighPeak. These costs include account investigation, documentation preparation, dispute handling, and external recovery services.

To offset these expenses, the customer expressly agrees to pay a contractual collection fee in addition to the unpaid balance and processor fees. The collection fee is determined by the original order total as follows:

• Orders under $250 — $50 collection fee
• Orders $250 to $749.99 — $100 collection fee
• Orders $750 and above — $150 collection fee

This collection fee is a contractual charge agreed to at the time of purchase and is not a penalty. It is intended to recover administrative and recovery-related expenses incurred when an account must be escalated due to non-payment.

HighPeak does not pursue collections lightly and will make reasonable efforts to resolve matters directly before any referral occurs.

Chargeback Processing Fees:

If a customer initiates a chargeback or payment dispute that results in processing fees, administrative costs, or penalties assessed to HighPeak by a payment processor, issuing bank, or card network, the customer agrees to remain responsible for any such fees incurred as a direct result of the dispute.

This applies regardless of shipment status, and includes disputes initiated prior to shipment, during processing, or after cancellation, where HighPeak was prepared to resolve the matter directly in good faith.

If the chargeback is determined to be valid due to confirmed unauthorized fraud or documented merchant error, HighPeak will not seek reimbursement of associated fees.

However, if the dispute was filed without first providing HighPeak a reasonable opportunity to resolve the matter directly, or where the underlying transaction was authorized and otherwise valid, the customer agrees that any processor-imposed chargeback fees may be recovered as part of the outstanding balance.

If only processor-imposed chargeback fees remain unpaid, and no product or transaction balance is owed, and the matter must still be referred to a licensed third-party collections agency after reasonable written notice and opportunity to resolve, the customer agrees to pay a separate contractual recovery fee of $35. This $35 recovery fee applies only where no unpaid product or transaction balance remains due and does not replace the collection fee schedule above.

22. AI Support Assistant

We provide access to an AI-powered support agent trained on HighPeak policies and products. While it can answer most questions, it may sometimes provide incomplete or inaccurate responses. Customers should confirm critical details by contacting support@highpeakco.com.

23. Order Now, Pay When Received

We offer a “Pay When Received” option for direct credit card orders. Your card is authorized at checkout but not charged until delivery is confirmed.

- This option does not apply to third-party payment providers (ShopPay, PayPal, Affirm, AfterPay, Klarna, etc.), which process payments immediately.

24. Changes to Terms

We reserve the right to update or replace these Terms at any time by posting changes to this page. Continued use of the site constitutes acceptance of changes.

26. Support Conduct & Respectful Communication Policy

HighPeak is committed to providing respectful, professional, and human-centered customer support. Our support team consists of real people, and we expect all customer communications to remain respectful and free from harassment, threats, or abusive language.

Abusive, hostile, or degrading communication can cause real harm to the people providing support. For this reason, HighPeak maintains a zero-tolerance standard for harassment, threats, or abusive language directed toward our support agents.

Abusive conduct includes, but is not limited to:

- hostile, threatening, or degrading language
- repeated aggressive or harassing messages
- intimidation, coercion, or personal attacks toward support staff

If communication becomes abusive or disrespectful, HighPeak reserves the right to temporarily pause or restrict support services until respectful communication is restored. Support will resume immediately once communication meets this standard.

In cases of repeated or severe abusive conduct, HighPeak may, at its sole discretion:

- close the support request
- restrict or terminate customer accounts
- refuse further service, as permitted by law

This policy exists to ensure a safe, professional environment for both our customers and our team. By contacting HighPeak support, you acknowledge and agree to comply with this Support Conduct Policy.

27. Intellectual Property Concerns and Rights Owner Notices

HighPeak respects the intellectual property rights of brands, creators, manufacturers, distributors, and rights owners.

HighPeak operates as an online marketplace and product discovery platform. Product listings may include content, specifications, images, descriptions, or product information provided by suppliers, vendors, brand partners, distributors, manufacturers, or other third-party sources.

If a rights owner or authorized representative believes that a product listing on HighPeak infringes a copyright, trademark, patent, or other intellectual property right, they should submit a notice through HighPeak’s Intellectual Property Concern process.

To submit a notice, rights owners should provide the HighPeak product URL, contact information, proof of ownership or authorization, a description of the allegedly infringing material, the intellectual property right at issue, and the requested action.

HighPeak may remove, edit, restrict, disable, or request additional documentation for listings when valid concerns are identified. Submission of a notice does not guarantee removal, and HighPeak reserves the right to evaluate notices in good faith based on the information provided.

28. Rental Return & Late Fee Policy

For all HighPeak rentals, the return deadline will be listed in your rental confirmation email or rental instructions.

Return Deadline
Rental items must be dropped off with the designated carrier by the required return date using the prepaid return label provided by HighPeak.

When a Return Counts as On Time
A rental is considered returned on time if:

1. The carrier tracking shows the package was accepted/scanned by the deadline; or
2. You email HighPeak a valid drop-off receipt by the deadline showing the date, time, tracking number, and carrier acceptance.

If Tracking Has Not Updated
If you dropped off the rental but the carrier tracking has not updated, please email us the drop-off receipt right away. Without a carrier scan or valid drop-off receipt, the rental will be considered late.

Late Fees
If the rental is not scanned by the carrier or supported by a valid receipt by the return deadline, a late fee of 20% of the original rental price per calendar day will apply until the rental is scanned or valid proof of drop-off is provided.

Impact on Other Rentals
HighPeak rental items may be reserved for other customers after your rental period. If a late return causes HighPeak to miss, cancel, refund, discount, delay, or lose another rental, the customer may be responsible for the affected rental value and related costs.

Unreturned Rentals
If a rental is not returned, the customer may be charged for the replacement value of the item, accrued late fees, shipping costs, recovery costs, and related expenses allowed by law.

Collections & Account Restrictions
HighPeak will make multiple reasonable attempts to resolve overdue rentals directly with the customer before referring an account to collections. These attempts may include email notices, return reminders, phone calls, replacement return-label assistance, final return deadlines, and opportunities to pay any outstanding balance directly to HighPeak.

A rental account may be referred to collections only as a final measure when the customer fails to respond, fails to return HighPeak’s property, fails to pay the outstanding balance, or otherwise refuses to comply with the Rental Agreement after repeated notices and opportunities to resolve the matter.

If rental property remains unreturned for 14 calendar days after the required return date, or if the customer fails to pay an outstanding rental balance by the final written deadline, HighPeak may classify the account as seriously delinquent and refer it to collections.

Upon referral to collections, the amount submitted for recovery will equal two times the documented replacement value of the unreturned rental property, plus any unpaid late fees, missing-item charges, damage charges, shipping costs, lost-rental damages, or other amounts authorized under this Agreement.

For example, if the documented replacement value of an unreturned rental is $1,500.00, the collections recovery amount based on the replacement value will be $3,000.00, before any other applicable charges.

This increased collections amount reflects the significant additional costs, time, administrative work, third-party collection expenses, and loss incurred when a customer retains HighPeak property and ignores repeated opportunities to return it or resolve the balance directly.

Customers can avoid collections and the increased recovery amount by:

  • Returning all rental property by the required deadline as agreed;
  • Responding promptly to HighPeak’s notices;
  • Communicating immediately if a return problem occurs; and
  • Paying all valid late fees and related charges before the final collections deadline.

Customers with unreturned rental property, unpaid balances, unresolved late fees, or accounts referred to collections may be permanently banned from future HighPeak purchases, rentals, memberships, promotions, and services.

Collections are a final recovery measure—not HighPeak’s preferred outcome. Customers are always given reasonable opportunities to return HighPeak’s property and resolve the matter directly before an account reaches this stage.
